• You will not use VPNs, proxies, or other means to circumvent geographic restrictions

Consequences of Circumvention:

• Immediate account termination without warning
• No refund of any paid features or subscriptions
• Permanent ban from the Service
• Possible legal action if we suffer damages

We reserve the right to expand or modify restricted regions at any time as laws change. Users in affected regions will be notified and given reasonable time to export their data before access is terminated.

4. Your Account

Account Registration:

❌ STRICTLY PROHIBITED CONTENT:

Illegal and Exploitative Content (Zero Tolerance):

• Minors in any capacity - Anyone under 18 in any sexual, suggestive, or exploitative context
• Child sexual abuse material (CSAM) - Zero tolerance, reported to NCMEC and law enforcement
• Non-consensual content - Revenge porn, hidden cameras, leaked intimate images
• Sex trafficking or exploitation - Content depicting or facilitating human trafficking

Multi-Person Explicit Sexual Content (2257 Compliance):

• Sexual intercourse between people - Vaginal, anal, or oral sex between two or more people
• Multi-person explicit sexual acts - Group sexual activity of any kind
• Partner penetration - Penetration by another person (fingers, toys, body parts)
• Explicit sexual contact between people - Genital-to-genital, oral-genital, or anal-genital contact
• Hardcore pornography - Professional or amateur multi-performer explicit content
• Content requiring 18 USC § 2257 record-keeping - Any sexually explicit conduct between multiple people

Why we prohibit multi-person content: Federal law (18 USC § 2257) requires platforms hosting multi-person sexually explicit content to maintain extensive records verifying the age and identity of every performer. We avoid this compliance burden by restricting content to solo performers only.

Harmful and Violent Content:

• Bestiality or animal abuse - Sexual contact with animals or animal cruelty
• Necrophilia - Sexual content involving deceased individuals
• Extreme violence or gore - Graphic depictions of serious injury, death, or mutilation
• Content promoting self-harm - Encouraging suicide, self-injury, or eating disorders
• Snuff content - Actual or simulated death during sexual acts

Privacy Violations:

• Doxxing - Posting private information (addresses, phone numbers, documents) without consent
• Hidden camera content - Recording people without their knowledge or consent
• Leaked private content - Sharing others' private photos/videos without permission

Harassment and Hate:

• Harassment or bullying - Targeted abuse, threats, stalking
• Hate speech - Content attacking people based on race, ethnicity, religion, disability, gender, sexual orientation, etc.
• Violent threats - Threats of physical harm or death

Intellectual Property Violations:

Fraudulent and Deceptive Content:

Other Prohibited Activities:

• Attempting to access accounts or data without authorization
• Interfering with the Service's operation or security
• Using the Service for any illegal purpose
• Violating any local, state, federal, or international law

Content Moderation Discretion:

We reserve the right to determine, in our sole discretion, whether content violates this policy. Edge cases will be evaluated based on context, intent, and community safety. When in doubt, don't post it.

6. Your Content and Responsibilities

Content Ownership: You retain ownership of content you post ("User Content"). By posting, you grant PeachBunni a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content as necessary to operate the Service.

Your Representations and Warranties:

By uploading any content to PeachBunni, you explicitly represent, warrant, and confirm that:

• You are 18 years or older and have full legal capacity to enter into this agreement
• All people depicted in your content are 18 years or older at the time of creation
• All people depicted have provided explicit consent to appear in the content and for it to be shared publicly
• You have all necessary rights, licenses, and permissions to upload and share the content
• The content does not violate these Terms or our Community Guidelines
• The content does not violate any laws including copyright, privacy, or criminal laws
• You are solely and fully responsible for all content you upload
• You will maintain documentation of age and consent for anyone appearing in your content

Content Attestation:

Every time you upload content, you will be required to confirm your understanding and agreement with these representations. This attestation is legally binding and creates a record of your acknowledgment.

Legal Responsibility:

You acknowledge and agree that:

• You bear all legal responsibility for content you upload
• You will indemnify PeachBunni for any claims arising from your content
• False representations may result in account termination and legal action
• You may be held criminally liable for uploading illegal content

Content Removal Rights: We reserve the right to remove any content, at any time, for any reason or no reason, without prior notice.

No Obligation to Host: We have no obligation to store or make available any User Content.

Backup and Deletion: You are responsible for maintaining backups of your User Content. We do not guarantee permanence; deleted content may remain in backups or caches temporarily.

7. Copyright and DMCA Compliance

PeachBunni respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

Filing a DMCA Takedown Notice: If you believe that content on PeachBunni infringes your copyright, you may submit a takedown notice to our designated DMCA agent. Your notice must include:

1. Your physical or electronic signature
2. Identification of the copyrighted work claimed to have been infringed (or a representative list)
3. Identification of the allegedly infringing material with specific URLs
4. Your contact information (name, address, phone number, email address)

8. Community Moderation, Reporting, and Enforcement

Reporting Tools: You can report content or users that violate these Terms using our in-app reporting tools. Report types include:

• Prohibited content (multi-person explicit acts, hardcore content)
• Suspected minor or CSAM
• Non-consensual or revenge porn
• Harassment, threats, or hate speech
• Copyright infringement
• Spam or fraud
• Privacy violations
• Other Terms violations

Reporting Process:

• Reports are reviewed by our moderation team within 24-48 hours
• Urgent reports (CSAM, threats of violence) are prioritized and reviewed immediately
• You may be contacted for additional information
• Reporters' identities are kept confidential
• We will notify you of the outcome when appropriate

Strike System and Enforcement Actions:

We enforce our Terms through a progressive strike system:

Immediate Termination (No Warnings):

We reserve the right to immediately terminate accounts without prior warnings for:

• CSAM or content depicting minors in any sexual context
• Non-consensual intimate content or revenge porn
• Content depicting or facilitating illegal activities
• Repeated severe violations after prior warnings
• Circumventing geographic restrictions (VPN use from blocked states)
• Operating fake accounts or bot networks
• Attempting to hack, exploit, or compromise the Service

Moderation Actions Available:

• Content removal (with or without notification)
• Formal warning and strike issuance
• Temporary suspension (24 hours to permanent)
• Account termination and permanent ban
• Feature restrictions (e.g., disabling uploads, commenting)
• IP address blocking
• Reporting to law enforcement when required by law

Appeals Process:

If you believe moderation action was taken in error:

• You may appeal within 14 days via our Contact page
• Include: your username, the specific action taken, and why you believe it was an error
• Appeals are reviewed by a different moderator
• Decisions on appeals are final
• Frivolous or abusive appeals may result in additional action

User Tools: You can block users, report content, leave/mute groups, and adjust privacy settings.

No Obligation to Moderate: While we strive to maintain a safe community, we are not obligated to monitor all content. We rely on user reports and automated systems. You acknowledge that prohibited content may appear before we can remove it.

9. Premium Features and Payments (When Available)

Note: Premium features are not currently available but may be offered in the future.

Premium Subscriptions:

PeachBunni may offer optional premium subscriptions that provide enhanced platform features. Premium features do NOT include payment to creators for content or monetization of user content. Premium features may include:

• Verified badge and account verification
• Ad-free browsing experience
• Unlimited uploads and storage
• Advanced search and filtering tools
• Detailed analytics and insights
• Custom profile themes and branding
• Priority customer support
• Early access to new features
• Other platform enhancement features

Billing Terms:

• Subscriptions are billed monthly or annually as selected
• Prices are in USD unless otherwise stated
• Payment is processed by our third-party payment processor
• You authorize recurring charges to your payment method
• Taxes may apply based on your location
• Price changes will be communicated 30 days in advance

Cancellation and Refunds:

• You may cancel your subscription at any time through account settings
• Cancellation takes effect at the end of your current billing period
• No refunds or credits for partial subscription periods
• No refunds if your account is terminated for Terms violations
• All sales are final except as required by applicable law

Changes to Premium Features:

No Guarantees: We do not guarantee that:

• The Service will meet your requirements or expectations
• The Service will be uninterrupted, timely, secure, or error-free
• Results from using the Service will be accurate or reliable
• The quality of any content or features will meet your expectations
• Any errors or defects will be corrected
• The Service will be free from viruses or harmful components

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEACHBUNNI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• DAMAGES RESULTING FROM: (a) your access to or use of or inability to access or use the Service; (b) conduct or content of any third party or user; (c) unauthorized access, use, or alteration of your content; (d) any content obtained from the Service
• ANY DAMAGES, LOSSES, OR INJURIES ARISING FROM YOUR USE OF THE SERVICE

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (a) AMOUNTS YOU HAVE PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM; OR (b) $100 USD.

Section 230 Protection: Under 47 U.S.C. § 230, we are not liable for user-generated content posted by third parties.

• Your violation of any rights of another person or entity

• Content you uploaded depicting minors or non-consensual content
• Claims arising from your circumvention of geographic restrictions

We reserve the right to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with our defense and will not settle any matter without our prior written consent. This indemnification obligation survives termination of these Terms and your use of the Service.

15. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by and construed in accordance with the laws of the State of New York and applicable United States federal law, without regard to conflict of law principles.

Jurisdiction and Venue: You agree to the exclusive jurisdiction and venue of the state and federal courts located in Nassau County, New York for any disputes arising from these Terms or your use of the Service.

Mandatory Arbitration: Except for disputes that may be taken to small claims court, any controversy or claim arising out of or relating to these Terms or the Service shall be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in New York, or remotely via video conference.

Class Action Waiver: YOU AND PEACHBUNNI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You waive any right to a jury trial.

Opt-Out Right: You may opt out of the arbitration and class-action waiver by sending written notice to us within 30 days of first accepting these Terms via the Contact page, including your name, address, username, and a clear statement that you wish to opt out of arbitration.

Severability of Arbitration Clause: If the class-action waiver is found to be unenforceable, the entire arbitration provision shall be void, and disputes will be resolved in court.

18. Account Termination and Service Discontinuation

Termination by You: You may delete your account at any time through account settings or by contacting support. Upon deletion:

• Your access to the Service will immediately cease
• Your content will be removed from public view (subject to technical limitations)
• Some information may be retained as required by law or legitimate business purposes
• Deleted content may persist in backups for up to 90 days

Termination by Us: We may suspend or terminate your account immediately, with or without notice, for:

• Engaging in illegal activity or facilitating others' illegal activity
• Fraud, impersonation, or misrepresentation
• Creating risk or possible legal liability for PeachBunni
• Harm to other users, the community, or our business
• Circumventing geographic restrictions

Effect of Termination:

• All rights and licenses granted to you immediately cease
• We may delete your account, content, and data
• You remain responsible for all obligations incurred before termination
• Certain provisions of these Terms survive termination (see Section 17)

No Refunds: If your account is terminated for violating these Terms, you are not entitled to any refund of subscription fees or other payments.

Service Discontinuation: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
